Good Morninig. Because I do not have enough information to identify the account in our system which you are referring to, the following information is based on our general operating procedures.
It was observed in your statements that you disputed the item with Experian and they later removed the item from your credit report. Please know that Experian would have notified us of your dispute, it is likely that we responded to that dispute to remove the item from credit reporting due to the fact that the address on file did not match your current address. It is also important for you to be aware that Rickenbacker reports to Experian, Trans Union and Equifax.
We have policies and procedures requiring that ALL of our agents comply with corporate, state and federal guidelines. In addition, they are required to attend extensive training including collection law, prior to any communications with our clients. The Compliance Department regularly monitors and audits the activities of the Collections Department. Unfortunately, we do not have the resources to perform daily audits of every account activity.
Privacy laws prevent entities from accessing DMV records of third parties without the proper certifications through the state. The information we have on file was originally obtained by our client (the towing company) and is utilized in debt vailidation.
You have also stated that you sold the vehicle in question prior to the tow date. There are options available to you as a consumer regarding your dispute. Please do not hesitate to contact me directly so that we can discuss your dispute and the investigation process in more detail.
