My complaints are as follows: The Justhost.com website posts a picture of “100% money back satisfaction guarantee” this is an implied contract. If the implied contract is breached there should be damages. They also feature “anytime money back guarantee” on their website. This is clearly an example of false advertising.
They also created a circuitous refund process designed to hinder attempts at retrieving a refund. After 1 phone call, 1 live customer service web chat, and 3 emails my issues have not been resolved.
I was not given sufficient notice of the billing to be allowed a complete refund under the supposed terms and conditions of service. I did not consent to have my credit card charged by them for a second year of services.
The terms of service were made under false pretenses; the website creates the illusion that a customer can receive a refund (see above complaint of false advertising). The misrepresentation of the terms of service creates a vitiating factor that means that the terms of service are in fact void.
Given that I contacted them prior to the billing date and start of services and neither authorized the billing or the services, I am entitled to a full refund and not a remainder. They supposedly issued a partial refund (which I have yet to receive) and with which I am extremely unsatisfied.
I ask the better business bureau to lower their rating of this company. This company is not deserving of the “B” label in that their business model makes fraudulent claims, makes unauthorized charges to customer’s accounts, and provides an intentionally circuitous customer feedback system designed to frustrate attempts at getting them to fulfill their promises as advertised.
I have given consideration as to the merits of filing a small claims suit against them to reclaim monies not refunded to me. I would not recommend this company and its services to anyone.
